Prohibits ADES from paying any claim found to be ineligible or fraudulent and requires those instances to be referred for prosecution. Requires an individual to be disqualified for benefits if ADES finds the individual has failed to actively seek and apply for or accept suitable work if offered. Requires an employer to report to ADES when an individual who was previously employed with that employer refuses to return to work, refuses to accept an offer of suitable work, fails without cause to appear for a scheduled interview, or fails to respond to an offer of employment. HB2501 - Community college districts; county removal

Summary: Stipulates that if a district contains two or more counties, 10% of the qualified electors in any county within the district may petition to remove that county from the district, and requires that a new district be formed in adherence to state law and if a county that is removed from a district does not meet the minimum requirements to form a new district, that county is no longer part of an established community college district. When removed, the community college district board in coordination with the county Board of Supervisors shall prepare a list of assets before the end of the fiscal year in which a new district election is held. Stipulates that all taxable property in the removed district remains taxable for payment of indebtedness lawfully incurred by the district while the county was within the district it was removed from and that the removed county is required to levy taxes sufficient to pay off that debt and if a removed county deposits with a trustee or escrow agent monies sufficient to cover that debt, no tax levy is required. Permits the removed county to sell assets transferred from the district for the purposes of retiring the debt.

Summary: Prohibits a financial institution to require any merchant retailer or sporting goods retailer to use a merchant category code indicating a firearms or ammunition purchase and permits any person to file a complaint with the Arizona Attorney General alleging a violation of this legislation and if the Attorney General declines to investigate or finds no violation, that person may file a complaint in a court of competent jurisdiction. Requires the Court to order a financial institution it finds is guilty of a violation of this legislation to remedy the complaint within 30 days and to destroy any protected financial information. Requires the court, if the violation is not remedied within 30 days to enjoin the financial institution from collecting any additional protected financial information, require the financial institution to surrender any license to do business in the sate for a period of up to five years, impose a civil penalty of up to $50,000 on the financial institution, and order any other relief the court finds is appropriate.

Summary: The 2024 general election ballot is to carry the question of whether to amend the Arizona Constitution to constitutionally continue the Permanent State School Fund (Fund) annual distribution rate of 6.9% through FY2035 and revert all other permanent fund annual distribution rates to 2.5% beginning in FY2026, effective only if voters approve the statutory measure that establishes a statewide program to increase the base salary of all eligible teachers above the FY2025 base salary. Increases, for FY2026-35, the Fund's annual distribution rate to 6.9% (from 2.5%) of the average monthly market valuation of the Fund for the previous five calendar years.  Requires, for FY2026-35, any increase in expendable earnings that would otherwise go to the Classroom Site Fund that results from a distribution of more than 2.5% of the average monthly market valuation of the Fund for the immediately preceding five calendar years to be appropriated for the statewide program to increase the base salary of all eligible teachers. Reverts, beginning in FY 2036, the Fund's annual distribution to 2.5% of the average monthly market valuation of the Fund for the previous five calendar years.  Applies the requirement for the Office of Strategic Planning and Budgeting (OSPB) and the Joint Legislative Budget Committee (JLBC) to jointly notify outlined individuals that a reduction to the distribution is necessary to preserve the safety of the capital in a permanent fund if the value of the permanent fund for the immediately preceding five calendar years has decreased compared to the value of a permanent fund for the five-calendar-year period immediately preceding those five years; and the authorization for the Legislature, with approval of the Governor, to enact legislation that reduces the distribution for the next fiscal year to between 2.5% and 6.9% of the value of the Fund upon receipt of OSPB’s and JLBC’s notification, to the Fund's annual distributions in FY2026-35. Specifies that, beginning in FY 2026, the annual distribution of each permanent fund other than the Fund reverts to 2.5% of the average monthly market valuation of the permanent fund. Becomes effective if approved by the voters and on proclamation of the Governor.

Summary: The 2024 general election ballot is to carry the question of whether to amend the Arizona Constitution to approve an increased distribution rate from the state land trust permanent funds. Requires, if the amendment is approved, revised salary schedules to increase the base salary of all eligible teachers that is the amount estimated by the Arizona State Treasurer that will be deposited in the Teacher Pay Fund (Teacher Fund) for the budget year, and the same amount for each “eligible teacher” (defined) without regard to experience levels. Prohibits a school from reducing the base salaries of an eligible teacher below the salary reported by the Arizona Department of Education (ADOE) FY2024-25 with certain exceptions. Establishes the Teacher Fund consisting of legislative appropriations and distributions from the permanent State School Fund. Provides that monies in the Teacher Fund are continuously appropriated and are exempt from lapsing. Requires ADOE to administer the fund and establish procedures. Establishes guidelines for allocation of monies. Prohibits Teacher Fund monies from causing any reduction in other funding sources for the school. Exempts Teacher Fund monies from revenue control limits. Requires ADOE to allocate monies appropriated by the legislature to the Teacher Fund according to the terms of the appropriation for salary increases not required by this statute. Requires the Arizona State Treasurer, by March 30 of each year, to provide the Joint Legislative Budget Committee with an estimate of the amount that will be deposited in the Teacher Fund for the budget year. Requires the Joint Legislative Budget Committee, by March 30 of each year, to determine a per teacher amount from the Teacher Fund for the budget year based on listed considerations. Requires each school that receives monies to submit a yearly report by November 15 to the Superintendent of Public Instruction. Requires ADOE in conjunction with the Arizona Auditor General (AAG) to prescribe the format of the report. Requires ADOE, on report from AAG, to determine whether schools are in compliance. If ADOE determines that a school is not in compliance or has not corrected a deficiency within 90 days, the school is ineligible to receive monies from the Teacher Fund until the AAG reports that the school is in compliance. Requires a charter school budget to include the number of eligible teachers employed by the school for the current year and their salary schedule.

Each school district that uses the state student funding formula and each charter school will calculate the base support level as already prescribed in statute and add the base support level to state additional assistance. The amount of state additional assistance is $2,025.29 per student count in preschool programs for students with disabilities, kindergarten programs, and grades 1 through 8, and $2,360.44 per student count in grades 9 through 12. For charter schools, the base support level is the equalization assistance for the charter school. A school district that provides instruction to students in any combination of kindergarten programs and grades 1 through 12 is authorized to elect to use the state student funding formula to determine the school district’s support level if the district does not have an override in place and either does not owe any debt service payment on any class A or class B bond or has four or fewer remaining fiscal years in which it is scheduled to make payments on any class A or class B bond. If the estimated total school district primary property tax rate will be greater than the prior year when electing to use the state student funding formula, the school district governing board is required to submit the question of whether to use the formula to the voters. A school district that is using the state student funding formula is prohibited from using any other source of property tax-generated funding and from receiving district additional assistance. Establishes a calculation for school district property tax levies in districts that use the state student funding formula and establishes the qualifying tax rates in tax year 2023 for school districts that elect to use the state student funding formula. Establishes that for a high school district or common school district within a high school district that does not offer instruction in high school subjects is $2,059 and in a unified school district, a common school district not within a high school or a common school district within a high school district that offers instruction in high school subjects is “$4,1119.”

Reverts, beginning in FY 2036, the Fund's annual distribution to 2.5% of the average monthly market valuation of the Fund for the previous five calendar years.  Applies the requirement for the Office of Strategic Planning and Budgeting (OSPB) and the Joint Legislative Budget Committee (JLBC) to jointly notify outlined individuals that a reduction to the distribution is necessary to preserve the safety of the capital in a permanent fund if the value of the permanent fund for the immediately preceding five calendar years has decreased compared to the value of a permanent fund for the five-calendar-year period immediately preceding those five years; and the authorization for the Legislature, with approval of the Governor, to enact legislation that reduces the distribution for the next fiscal year to between 2.5% and 6.9% of the value of the Fund upon receipt of OSPB’s and JLBC’s notification, to the Fund's annual distributions in FY2026-35. Specifies that, beginning in FY 2026, the annual distribution of each permanent fund other than the Fund reverts to 2.5% of the average monthly market valuation of the permanent fund. For FY2025-26 through 2035-36, appropriates any increase in expendable earnings resulting from a distribution of more than 2.5% of the average monthly market values of the fund for the immediately preceding five calendar years to school districts, charter schools and the Arizona State Schools for the Deaf And The Blind as follows: 4.4% to hire and to increase compensation for “teachers” (defined) and “classroom support personnel” (defined); 1.5% to hire and to increase compensation for “student support services personnel” (defined); 0.5 to award grants to support the costs of capital and technology expenses. Requires an affirmative vote of two-thirds of each house of the legislature, and approval by the governor, for any legislation that reduces distributions from the Fund, including inflation adjustments required by statute.

SCR1034 - Schools; teacher salary increases; reporting

Summary: The 2024 general election ballot is to carry the question of whether to amend the Arizona Constitution to approve an increased distribution rate from the state land trust permanent funds. Requires, if the amendment is approved, revised salary schedules to increase the base salary of all eligible teachers that is the amount estimated by the Arizona State Treasurer that will be deposited in the Teacher Pay Fund (Teacher Fund) for the budget year, and the same amount for each “eligible teacher” (defined) without regard to experience levels. Prohibits a school from reducing the base salaries of an eligible teacher below the salary reported by the Arizona Department of Education (ADOE) FY2024-25 with certain exceptions. Establishes the Teacher Fund consisting of legislative appropriations and distributions from the permanent State School Fund. Provides that monies in the Teacher Fund are continuously appropriated and are exempt from lapsing. Requires ADOE to administer the fund and establish procedures. Establishes guidelines for allocation of monies. Prohibits Teacher Fund monies from causing any reduction in other funding sources for the school. Exempts Teacher Fund monies from revenue control limits. Requires ADOE to allocate monies appropriated by the legislature to the Teacher Fund according to the terms of the appropriation for salary increases not required by this statute. Requires the Arizona State Treasurer, by March 30 of each year, to provide the Joint Legislative Budget Committee with an estimate of the amount that will be deposited in the Teacher Fund for the budget year. Requires the Joint Legislative Budget Committee, by March 30 of each year, to determine a per teacher amount from the Teacher Fund for the budget year based on listed considerations. Requires each school that receives monies to submit a yearly report by November 15 to the Superintendent of Public Instruction. Requires ADOE in conjunction with the Arizona Auditor General (AAG) to prescribe the format of the report. Requires ADOE, on report from AAG, to determine whether schools are in compliance. If ADOE determines that a school is not in compliance or has not corrected a deficiency within 90 days, the school is ineligible to receive monies from the Teacher Fund until the AAG reports that the school is in compliance. Requires a charter school budget to include the number of eligible teachers employed by the school for the current year and their salary schedule.
