Summary: Requires applicants awarded funding from the Rural Transportation Fund for design and other engineering services to apply for a federal grant within two years after the award, or the award lapses and the applicant must repay any expended monies to the fund. Requires the applicant to submit repayment within 30 days after receiving an invoice from the Arizona Department of Transportation (ADT.) Allows the Rural Transportation Fund Board (Board) to require additional documentation to ensure an applicant is eligible for a federal grant and to determine whether an applicant has the technical and financial capacity to complete the project. Allows the Board to give preference to applicants based on factors it deems appropriate for the applicable federal grant. Removes the requirement that an applicant notify the ADT within 15 days after receiving notice that the applicant has not secured the federal grant. Permits, starting January 1 and July one of each year, the Board to redistribute any unawarded monies in the fund to ensure each category receives a share of the monies based on the percentages prescribed by state law. Requires the ADT to post the amount available for each category on the ADT website within 30 days after approval of the redistribution of funds. Permits the Board to direct the ADT to close applications for any category and, if doing so, requires the Board to return unawarded applications to the applicants. Requires the board to rescind an award if an applicant receives funding from another source for the same project and purpose in an amount equal to or greater than the award made under this bill and requires the applicant to repay any monies expended from the fund within one year after the date of the recession resolution being approved by the board. Establishes the Commercial Truck Safety, Education and Workforce Fund, which is funded by monies deposited gifts, grants and other donations, plus, fees for various classifications of commercial vehicles. Stipulates that the Governor’s Office of Highway Safety shall administer the fund and the State Treasurer shall invest and divest monies in the fund. Describes the fee structure that will be used to collect monies for the fund. Directs ADOT to use monies deposited in the fund to improve trucking education and public safety, including aiding workforce development. Summary: Removes the Arizona State Schools for the Deaf and Blind from exemption from participating in the state motor vehicle fleet. Prohibits action against a person’s driving privileges or registration if a judicial officer reports a conviction or finding of responsibility more than five years after the action. Stipulates that a driver’s license is valid for up to five years if issued to someone 60 or older. Requires the Arizona Department of Transportation (ADT) check the Federal Motor Vehicle Carrier Safety Administration’s Drug and Alcohol Clearinghouse for all commercial applicants. If the Clearinghouse indicates a prohibition from having a commercial license, the applicant’s application for a commercial license or learner’s permit shall be denied and their status as a commercial driver or applicant downgraded; the downgrade is effective within 60 days after the department received notification of the driver’s prohibited status. If the Clearinghouse indicates an error was made and the applicant has no restrictions or prohibitions, their application should be immediately restored and their downgraded status removed and if the initial status has no prohibitions or restrictions, the application should be granted. A person wanting to dispute the revocation of a license or registration may do so by written request. ADT is required to publish a schedule of public hearings on highway projects and allow public input. ADT is no longer required to send notice by certified mail ordering the licensee’s appearance in the office to show cause why the license should not be revoked. At the time of applications and before registration each year, the registering officer no longer must provide the amount of the vehicle license tax the taxpayer would pay if the taxpayer’s motor vehicle was powered by alternative fuel. Requires ADEQ to adopt rules for the Program to specify zero-emission vehicle designs that qualify for the Program, establish procedures to prioritize monies, limit the number of rebates available to each class of zero-emission vehicles, allow a person who purchases a zero-emission vehicle to apply for a rebate for a portion of the purchase price of the vehicle or assign a rebate to a vehicle dealer. Requires ADEQ to prescribe a rebate application procedure, set an annual rebate cap that may vary for each class of zero-emission vehicles and award rebates only from monies available in the Zero-emission Vehicle Fund. Directs ADEQ to provide a procedure for the reimbursement of monies from zero-emission vehicle owners who receive a rebate but do not comply with prescribed requirements. Rebate decisions must be made within 60 days after the receipt of an application and ADEQ may waive a reimbursement requirement on a finding of unforeseeable or unavoidable circumstances. Allows ADEQ to adopt rules to provide additional rebates for fleet owners that purchase zero-emission vehicles that operate in an area subject to the emissions inspection program, and to hire an outside contractor to help implement or administer the zero-emission vehicle program. Outlines the criteria and required documentation for a person to apply for a rebate. Requires a rebate recipient to notify ADEQ of a transfer of title of a zero-emission vehicle or an emissions system modification. Creates the Zero-emission Vehicle Fund (Fund) consisting of legislative appropriations, federal monies and private gifts, grants, contributions and devises and monies transferred from the Waste Tire Fund. Tasks ADEQ with administering the Fund. States that Fund monies are subject to legislative appropriation. Allows ADEQ to use Fund monies to administer and award rebates pursuant to the Program.

Summary: Prohibits the Arizona Department of Transportation (ADOT) from building or maintaining facilities that charge motor vehicles other than government-owned motor vehicles charged on government property.  Prohibits ADOT from using public monies for training, orientation or therapy that presents any form of blame or judgment based upon race, ethnicity or sex.  Prohibits ADOT from using public monies to develop a carbon reduction plan or a plan or strategy to reduce greenhouse gas emissions, except that it may develop a plan if necessary to accept federal monies. ADOT may not implement any strategies identified in the plan without express legislative authorization. The statutory life of ADOT is extended. Stipulates that ADOT’s termination date is contingent on its implementation of the recommendations of the Arizona Auditor General (AAG) in the audit report issued August 2023 and the sunset review report issued in September 2023 as part of ADOT’s sunset review. Stipulates that ADOT terminates on July 1, 2029, if it has implemented less than 80% of the recommendations, July 1, 2030, if it has implemented 80-89% of the recommendations,  July 1, 2031, if it has implemented 90-99% of the recommendations, or July 1, 2032 if it has implemented 100% of the recommendations. Requires AAG to write a follow-up report 18 months after the sunset review report stating the percentage implemented by ADOT. AS PASSED SENATE.

Summary: Requires a critical telecommunications infrastructure located within, or that is serving the state to be constructed without any equipment manufactured by a federally banned corporation or any equipment that is banned by the federal government, manufactured in or by a foreign adversary, state-owned enterprise with a foreign adversary or is owned by a foreign adversary or a foreign adversary domiciled company. Requires any equipment that qualifies under the above definition to be removed, permanently disabled, and replaced and stipulates that a telecommunications provider that complies with that order does not have to obtain any additional permits provided the affected agency or service is notified of the change and that the replacement equipment or parts are similar to existing equipment or parts. Requires all telecommunications providers providing service in the state register with the Arizona Corporation Commission (ACC) and permits the ACC to charge a registration filing fee. Requires a registering company to provide all requested details on an official form the ACC creates and for the registering company to keep all required documentations as requested by the ACC and to notify the ACC if any of that information changes within 60 days after the change. Requires each registered service provider to certify by January 1 of each year that the provider is in compliance with this legislation and stipulates that violation of this provision is subject to a civil penalty between $10,000 and $100,000 per day for noncompliance. Prohibits any provider in violation of this legislation from receiving state or local monies for the development or management of critical telecommunications infrastructure projects and from receiving any federal monies for work in the state. Effective date is January 1, 2025 and entitles the Act the “Secure Telecommunications Act of 2024.” AS PASSED SENATE.

Summary: Requires the Arizona Department of Public Safety (ADPS)to revoke an authorization or certification if a third party who conducts vehicle inspections on behalf of this state, does not meet the state’s standards. The ADPS shall advise the third party in writing of the revocation and the grounds for the revocation.  Within thirty days after receipt of the notice of revocation, the third party may petition the ADPS in writing for a hearing on the revocation or seek judicial review of the revocation and if the court finds for the third party, the court may reinstate the authorization or certification, or both and award the party who had the revocation any damages or attorney fees. Requires the ADPS to revoke an application for an authorization or certification, or both, if the applicant does not adhere to the requirements set forth by the state, and in the case of a denial, the application may request in writing a hearing, or seek judicial review under the same criteria for authorization or certification instatement and awards. Sets forth ADPS rules for notification to the person denied and stipulates that a timely request for a hearing stays the revocation. Permits any person denied, suspended or cancelled by the ADPS to seek a judicial review and forego the administrative appeal and requires a court to reverse the denial, suspension or cancellation and award damages and legal fees if it finds merit in the applicant or revoked parties case. Summary: Prohibits any “light detection and ranging” (defined) equipment manufactured in or by a company domiciled, or owned by a company domiciled, in a “country of concern” (defined) (CoC) from being used for any new “state infrastructure” (defined) constructed in Arizona or included in procurement made by an agency or a political subdivision of the state. Requires any existing state infrastructure that is currently using prohibited light detection and ranging equipment to remove and replace the equipment within 90 days of the effective date of this legislation. Preempts an autonomous vehicle that includes any light detection and ranging equipment manufactured in or by a company domiciled in a CoC from being issued any certification, license or regulatory approval concerning the vehicle's approval, use or operation in Arizona. Prohibits any state, county, local or municipal governmental entity (agency) from purchasing, acquiring or using a drone, or any related equipment, produced by a manufacturer domiciled in, owned or controlled by a CoC a company owned by or domiciled in a CoC, except if an “agency” (defined) weighs the goals of the research against the risk to any networks or data when using a drone, uses the drone for research and accountability purposes only; and provides written notice stating the intended purpose of the use, the participants and any benefits of the research to the Arizona Department of Homeland Security (AZDOHS) at least 30 days before using a drone. Allows an agency to enter into a Public-Private Partnership Contract (PPP Contract) to finance or provide construction services or facilitate the development of state property and develop programs or services that enable a purchasing agency to expand or enhance any of its operations consistent with legal authority and the interests of Arizona. Outlines request for proposals, justification requirements from the affected agency, authorization processes, a prohibition on guaranteed funding and fee payment processes. Defines required contractual terms including automatic and selected extensions, purchase agent permissions and prohibitions, and requirements for legislative reporting. Outlines the scope of the Joint Committee on Capital Review responsibilities. Summary:   Permits law enforcement to issue a citation for a violation of the helmet requirement for minors riding a motorcycle, all-terrain vehicle, or motor driven cycle if the violator is 16 or 17 years of age and has been issued a driver’s license or permit. Exempts all three if operated as part of a farm operation and the vehicle is an agricultural vehicle, operated on private property or otherwise exempted by state law.  Permits an operator of any of the three to be issued a citation if their passenger is under 18 years of age and not wearing a protective helmet pursuant to state law, or if the operator is under 18 and is not wearing a protective helmet and is in the same group or party as the operator of the initial operator who is at least 18 years of age.
